Contract
The Contract for a short-term holiday rental shall be made between the Client and Ecopod. The Contract shall be governed by Scottish Law. The contract will be deemed to be entered into when the initial deposit is processed and Ecopod issues confirmation. The Contract will be subject to all of the following booking conditions.
1. Making a reservation
The website is fully functional to check current availability and to use online booking facility. A deposit of 50% is payable on booking, and balance of payment to be paid 8 weeks prior to arrival date. Non-payment of the balance of the rental due eight weeks before the arrival date shall be construed as a cancellation of the contract by the Client. .Bookings made within 8 weeks of arrival date are payable in full. Telephone and e-mail bookings will be held for 7 days pending receipt of deposit. Failing which after 10 days the provisional booking will be cancelled. On receipt of the deposit the booking will be confirmed.
2. Arrivals and departures
The pod will be ready for you by 3pm on the day of arrival, and must be vacated by 10am on day of departure. Please make sure you report to Castle Stalker View Gift Shop on arrival and you will be welcomed and taken to the accommodation. Any arrivals after 5pm should be notified in advance.
3. Cleaning and care of property
The Client shall take all reasonable and proper care of the property and its furniture, pictures, fittings and effects in or on the property and leave them in the same state of repair and in the same clean and tidy condition at the end of the rental period as at the beginning. If the property is left in an unacceptable condition, this may result in an additional cleaning surcharge.
4. Breakages or damage
The Client is legally bound to notify Ecopod of any breakages or damage to the property and reimburse them for replacement, repair or extra cleaning costs on demand. The Hirer will be responsible for all in his booking party and we reserve the right to take monies accordingly.
5. Pets
We welcome well-behaved pets but this must be arranged prior to booking. You as the Client are fully responsible for any damage which may be incurred during your stay. The pod must be left in the same tidy and clean condition as it was at the start of the rental period otherwise an additional cleaning charge will be deducted from your credit card.
6. Smoking
No smoking permitted inside the property.
7. Occupancy
The occupancy of the property should not extend beyond the number of people stated in the booking form. Maximum occupancy is two. Failure to observe this condition may invalidate the booking.
8. Vehicle/personal property
As well as cancellation and curtailment insurance, clients are recommended to take out holiday insurance to cover loss or damage to personal effects. Vehicles, accessories and contents are left at owners� risk. The proprietors will not be held responsible for any loss or damage or injury to persons not caused through the fault of the proprietor.
9. Restriction on rental
We reserve the right to remove person or persons from the property in any circumstances involving unreasonable behaviour, damage to the property or exceeding stated occupancy. In this case no refund will be given.
10. Cancellation
We strongly recommend that the Client takes out holiday insurance to minimise the cost and inconvenience of cancelled bookings. If the Client require to cancel a reservation for any reason we must be notified by telephone immediately and cancellation must be confirmed in writing within 5 days. In the event of a cancellation we will make every effort to re-let the property and the Client will be reimbursed in full. However, if we are unable to re-let, cancellation costs will be incurred as follows: More than 8 weeks before booked arrival date - deposit will be forfeited. Less than 8 weeks before booked arrival date - full cost of rental will be payble.
11. Availability
Each booking is made in good faith with the belief that the property will be available to the tenant on the date selected. If for any reason the property is not available due to circumstances outwith our control, we are unable to guarantee provision of alternative accommodation. In the event of this happening, the deposit and full balance will be refunded in full. The tenant will have no further claim against the proprietor.
12. Liability
Ecopod, its employees and agents do not accept third party liability in respect of breach of contract, negligence, misrepresentation or otherwise.
13. Warranties
Ecopod does not warrant and is not responsible for the accuracy of any verbal information given or statements made by any of its representatives.
14. Right of entry
Ecopod shall be allowed the right of entry to the property at all reasonable times for purposes of inspection or to carry out any necessary repairs or maintenance.
